Commentaire de Cass. com, 6 mars 2024, RLDA, juin 2024
The Court of Cassation (Cour de cassation) holds that a bank accused of having released promised funds late and without the agreed deferred amortisation period cannot rely on the provisions of Article L. 650-1 of the Commercial Code. The principle of non-liability laid down in that provision covers only loss suffered as a result of the financial support granted, and not as a result of its defective performance.
